New I-9 Form

Dealers know that their packages for new hires must include an I-9 Form to verify the identity
and eligibility of employees hired. The supplies of forms that dealers have in inventory may not
be up to date, however. The U.S. Citizenship and Immigration Services has revised Form I-9,
and employers must begin using the new form no later than May 7, 2013. The new form includes
new fields, it has been reformatted, and USCIS claims that it has clearer instructions to both
employers and employees.

The new form is now two pages. It provides a new field for an employee’s passport information
if one is used, and it provides for updated contact information in the event of the need of USCIS
to contact the employee because of a mismatch.

Employers may use the new version now, and must use the version no later than May 7, 2013.

FTC Issues New Guidance on Digital Disclosures

Last month, the staff of the Federal Trade Commission revised its guidance concerning online
advertising disclosures. The FTC staff noted that this revision of the original guidelines issued
in 2000 takes into account the expanding use of smart phones with small screens and the rise of
social media marketing.

The guidelines emphasize that consumer protection laws apply equally to all marketers
regardless of the medium, whether television, radio, print, or internet accessed on a desktop
computer or on a mobile device. Staff also emphasized that it will be guided by the primary
consideration of whether disclosures are clear and conspicuous.
