EEO-1 Pay Data By September 30, 2019

Last month we reported that a federal court in the District of Columbia ruled improper the federal Office of Management and Budget’s action blocking revision by the Equal Employment Opportunity Commission of its EEO-1 form to include pay data by race, ethnicity, and sex. The court recently ruled that covered employers must follow the Obama era EEOC rule revision and provide that pay information for 2017 and 2018 no later than September 30, 2019.

Unless something dramatic occurs to change this, covered employers will have to file EEO-1 reports of pay data by employees’ race, ethnicity, and sex for 2017 and 2018 by September 30, 2019. This will be a substantial undertaking for a dealership’s general office. This ruling does not affect the existing due date for EEO-1s providing traditional information that must still be filed with the EEOC by May 31, 2019.
