Current code prohibits a manufacturer from collecting chargebacks for warranty or sales incentive audits before a dealer exhausts its remedies under the franchise agreement and through DMV for disputing those amounts. This protects dealers from having to fight to get back their own money after succesfully disputing the chargebacks. This bill extends those same protections against having their money taken to administrative fees and other fines and charges that the manufacturer may try to assess the dealer for action that the manufacturer deems a violation of its policies.

 Sale of Motor Vehicles on Consignment (Auctions) 
HB 1539 (Greason) 

 

The bill revises the requirements concerning inspections of vehicles offered for sale at auctions - sales that are considered consignments under current Code. You may have seen the Dealer Board notice recently that reminded dealers that vehicles sold on consignment must have a current inspection. This means that vehicles with a rejection sticker cannot be sold at a retail auction under current law even though a dealer could sell the vehicle on their lot with a rejection sticker.

The bill corrects that inconsistency and allows the consignment sale of motor vehicles that fail to pass a safety inspection if the buyer is provided a written disclosure of the failed inspection. This is the same requirement dealers face on vehicles they sell on their lot after an inspection.

Workers Compensation

On behalf of the hundreds of dealers who are members of the VADA GSIA, we work every Session to ensure that Virginia's workers compensation system is fair for employers. This year, several measures have been introduced to address the steep increases in medical costs incurred by employers over the past several years. We will strongly support efforts to put in place a system to control those costs so that employers are not forced to pay more for workers comp medical claims than any other groups who have negotiated rates with health care providers.


 

OTHER ISSUES

Team VADA is tracking and working numerous bills which could impact your business.  Below are a few of these bills.

Electronic Tracking Devices: This bill would prohibit anyone from using an electronic device to track the location of another person. The penalty for the use of such devices is a Class 3 misdemeanor. We will work to ensure the bill does not impact dealer and lienholder business practices.

Scrap Metal: Several measures have been introduced to strengthen the requirements of record keeping in transactions for the sale of certain scrap metals to discourage the theft of those materials, including vehicle parts.

General Employer Related Items:
We are also involved in several issues that impact all employers generally, including proposed increases in unemployment and workers comp obligations and verification of the legal work status of employees. There are always many different bills introduced that effect Virginia employers and we work with our colleagues representing many groups to ensure Virginia employers do not see their costs skyrocket.
